The Spanish Supreme Court is to decide if banks or borrowers have to pay one of the mortgage taxes, after division arisen in the same court following an administrative division recently ruled that banks should cover the Impuesto sobre Actos JurĂdicos Documentados (AJD) -a tax for the notarial documentation of the sale and the loan- and not the clients, as it has been happening until now. The announcement, that provoked banks shares' dive in the Spanish Stock Market, contradicted a previous rule on the same issue and triggered big questions on who has to cover the cost and its possible retroactive application in previous mortgages contracts.
