Three years ago, the German Federal Court (BGH) already dealt with the Milka manufacturer's attempt to take away the monopoly on the square shape of its cocoa products from its competitor Ritter Sport. With varying degrees of success: the German Patent and Trademark Office had resisted the request because the packaging design had established itself on the market as a distinctive mark and was not technically necessary. However, the Federal Patent Court then deleted the three-dimensional shape mark at the request of Milka, which sells its products in purple packaging - a square is also just a special shape of a rectangle.
